WE EAT

TERMS OF USE

Effective Date: August 11, 2026

Last Updated: August 11, 2026

1. Introduction, Contracting Entity and Acceptance

Welcome to We Eat.

We Eat is a global social media platform dedicated to food, dining experiences, restaurants, cafés, recipes, cooking, chefs, creators, businesses, communities, and food discovery.

We Eat is owned and operated by xibalba For Computer Systems & Communication Equipment Software Design CO. L.L.C S.O.C, a Limited Liability Company – Single Owner, licensed in Dubai, United Arab Emirates under Commercial License No. 1494509 (“Company,” “We Eat,” “we,” “us,” or “our”).

These Terms of Use (“Terms”) govern your access to and use of the We Eat mobile application, website, platform, content, features, and current and future related services (collectively, the “Services”).

By creating an account, accessing or using the Services, or selecting “I Agree,” “Create Account,” “Sign Up,” or an equivalent confirmation, you acknowledge that you have read and understood these Terms and agree to be legally bound by them.

The Privacy Policy, Community Guidelines, and any additional terms applicable to subscriptions, purchases, promotions, or specific features form part of the legal framework governing your use of We Eat.

If you do not agree to these Terms, you must not create an account or use the Services.

Nothing in these Terms is intended to exclude or restrict any right or liability that cannot lawfully be excluded or restricted.

2. Eligibility and Age Requirements

You must be at least 13 years old, or the higher minimum age required by the laws applicable in your country or jurisdiction, to create a We Eat account or use account-based features.

If, because of your age, applicable law does not permit you to independently accept these Terms or provide legally required consent, consent or authorization from a parent or legal guardian must be obtained where required by law.

By creating an account, you represent and warrant that:

  • your date of birth and age information are accurate;
  • you satisfy the applicable minimum-age requirement;
  • you have the legal capacity to accept these Terms or have obtained any authorization required by law; and
  • your use of We Eat is not prohibited by applicable law.

We Eat may use reasonable age-screening, age-assurance, age-estimation, age-verification, parental-consent, or similar mechanisms where permitted or required by law.

We Eat may restrict, disable, or modify features for minors, including messaging, location, recommendations, advertising, public interactions, or other functionality, where reasonably necessary for safety or legal compliance.

We Eat may suspend or terminate an account where it reasonably believes that a user does not satisfy applicable age requirements or has provided materially inaccurate age information.

3. User Accounts and Account Security

Certain We Eat Services may require a registered account.

Users agree to provide accurate, current, and complete information and to keep material account information reasonably updated.

Users are responsible for protecting their login credentials and preventing unauthorized use of their accounts.

Users must not:

  • impersonate another person or organization;
  • provide materially false or misleading information;
  • sell, rent, or transfer accounts without authorization;
  • use another person’s account without permission;
  • create accounts for fraudulent or unlawful purposes;
  • create fake or unauthorized automated accounts; or
  • circumvent account restrictions, suspensions, bans, or terminations.

Users should promptly notify We Eat if they reasonably suspect unauthorized access to their accounts.

4. Nature of We Eat

We Eat is a global social media, technology, and discovery platform focused on food.

The platform may allow users to create, record, upload, publish, share, discover, save, rate, review, recommend, and interact with videos, photographs, recipes, restaurants, cafés, food experiences, beverages, cooking, culinary cultures, chefs, creators, businesses, and other food-related subjects.

We Eat may develop and introduce additional features and services in the future, subject to these Terms and applicable law.

5. User Content and Responsibility

“User Content” includes any video, photograph, audio, recipe, review, rating, comment, message, caption, profile information, link, or other material uploaded, published, transmitted, or shared by a user through We Eat.

Users retain ownership of intellectual property rights they hold in their User Content.

Uploading content does not transfer ownership of that content to We Eat.

Users are responsible for their User Content and for ensuring that they possess all rights, licenses, permissions, and authorizations necessary to upload and use it.

Users are also responsible for ensuring that their content and conduct comply with applicable laws, regulations, these Terms, and the Community Guidelines.

Users must not publish content that infringes another person’s intellectual property, privacy, confidentiality, publicity, image, or other legal rights.

6. License Granted to We Eat

By uploading or publishing User Content through We Eat, you grant We Eat a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, reproduce, encode, display, distribute, make available, technically adapt, promote, and otherwise use that content as reasonably necessary to:

  • operate We Eat and provide the Services;
  • display content to users;
  • enable sharing and interaction;
  • operate search and discovery;
  • operate recommendation systems;
  • perform moderation and safety functions;
  • prevent fraud and abuse;
  • protect the platform;
  • develop and improve the Services;
  • promote We Eat and content available through We Eat; and
  • comply with legal and regulatory requirements.

This license does not transfer ownership of User Content to We Eat.

The license generally ends following permanent deletion of the relevant content, except where continued retention or processing is reasonably necessary for backups, security, fraud prevention, investigations, disputes, legal claims, legal compliance, or where content has been shared or used in a manner that cannot immediately be reversed, subject to applicable law.

7. Food-Focused Platform

We Eat is focused on food and may establish technical or editorial standards concerning the relevance of content to food.

Artificial intelligence, automated systems, and human review may be used to assess whether content is suitable for the platform.

Content that does not satisfy applicable We Eat content requirements or Community Guidelines may be rejected, restricted, deprioritized, or removed.

We Eat may modify technical or editorial content standards as the platform evolves.

Acceptance or publication of content does not guarantee that the content will remain available, distributed, recommended, or ranked in any particular manner.

8. Artificial Intelligence, Algorithms and Automated Systems

We Eat may use artificial intelligence, machine learning, algorithms, automated systems, and human review to operate, develop, improve, and protect the Services.

These technologies may be used for:

  • food-content detection;
  • content analysis and classification;
  • recommendations and personalization;
  • search and discovery;
  • ranking and distribution;
  • fraud detection;
  • spam detection;
  • security;
  • moderation;
  • detection of potentially prohibited content; and
  • protection of users and the platform.

Automated systems may accept, classify, flag, restrict, reject, deprioritize, or remove content.

We Eat does not guarantee that automated or human systems will be completely error-free.

Review or appeal mechanisms may be provided where offered by We Eat or required by applicable law.

9. Prohibited Content and Conduct

Users must use We Eat lawfully and responsibly.

Subject to these Terms, the Community Guidelines, and applicable law, prohibited conduct may include:

  • fraud and deception;
  • impersonation;
  • harassment, bullying, or threats;
  • prohibited hateful conduct;
  • sexual exploitation;
  • child exploitation or endangerment;
  • unlawful or exploitative sexual content;
  • promotion of terrorism or violent extremism;
  • credible threats of violence;
  • unlawful activity;
  • intellectual property infringement;
  • unlawful invasion of privacy;
  • malware or phishing;
  • financial fraud;
  • manipulation of views or engagement;
  • fake likes, followers, or ratings;
  • spam;
  • fraudulent reviews;
  • unlawful sale or promotion of prohibited goods or services; or
  • attempts to circumvent security, moderation, payment, age, or other restrictions.

The We Eat Community Guidelines apply in addition to this Section.

10. Moderation, Reporting and Blocking

We Eat may use automated systems and human reviewers to review content, accounts, and platform activity.

Users may report content or accounts they reasonably believe violate these Terms or the Community Guidelines.

Users may block other users using available platform functionality.

Depending on the nature, severity, frequency, context, and applicable law, We Eat may:

  • reject content;
  • remove content;
  • reduce distribution or visibility;
  • disable comments;
  • disable messaging or other features;
  • issue warnings;
  • restrict accounts;
  • suspend accounts;
  • permanently terminate accounts;
  • remove artificial engagement;
  • prevent circumvention of enforcement measures;
  • preserve relevant information or evidence; and
  • report suspected unlawful conduct to competent authorities where legally required or permitted.

We Eat does not guarantee immediate detection of every violation.

11. Restaurants, Cafés, Businesses and Other Third Parties

We Eat may contain information and content relating to restaurants, cafés, chefs, creators, brands, products, menus, prices, locations, operating hours, promotions, ratings, and other matters.

Such information may originate from users, restaurants, businesses, or other sources and may change, be incomplete, or become inaccurate.

Unless expressly stated otherwise, the appearance of a restaurant, establishment, product, brand, or account on We Eat does not mean that We Eat owns, operates, inspects, certifies, endorses, or guarantees it.

To the maximum extent permitted by applicable law, We Eat does not guarantee the accuracy or validity of:

  • prices;
  • menus;
  • operating hours;
  • product availability;
  • food quality;
  • service quality;
  • licensing status;
  • hygiene;
  • food safety; or
  • claims made by independent third parties.

Users are responsible for independently verifying material information before making decisions.

12. Reviews, Ratings and Opinions

Users may share genuine opinions and experiences, including negative opinions and experiences, provided they comply with applicable law, these Terms, and the Community Guidelines.

Users must not:

  • create fake reviews;
  • claim experiences they know did not occur;
  • extort businesses in exchange for modifying or removing reviews;
  • coordinate fraudulent rating manipulation;
  • create fake accounts to manipulate ratings; or
  • knowingly publish materially false allegations.

Reviews and opinions represent the views of their authors and do not necessarily represent the views of We Eat.

13. Food, Recipes, Allergies, Health and Nutrition

Content relating to food, recipes, ingredients, restaurants, nutrition, diets, cooking, and allergies is primarily provided for social, informational, discovery, and entertainment purposes.

Unless expressly stated otherwise, We Eat does not independently verify or guarantee:

  • ingredients;
  • allergens;
  • cross-contamination risks;
  • calories or nutritional information;
  • preparation methods;
  • cooking temperatures;
  • food safety;
  • dietary claims;
  • health claims;
  • suitability of food for a particular individual; or
  • halal, kosher, vegan, vegetarian, or other dietary claims.

Users are responsible for independently verifying relevant information before preparing or consuming food.

Nothing available through We Eat constitutes medical, therapeutic, nutritional, dietary, or other professional advice.

Users with allergies, medical conditions, or specific dietary requirements should verify information directly with the relevant food provider and obtain appropriate professional advice where necessary.

14. External Links, Orders and Third-Party Destinations

Certain We Eat plans or features may allow users, restaurants, creators, or businesses to add external links, including links to:

  • websites;
  • personal or business pages;
  • menus;
  • ordering pages;
  • reservation systems;
  • online stores;
  • social media;
  • or other independent services.

Unless We Eat expressly states otherwise, providing or allowing an external link does not make We Eat the seller, restaurant, food provider, payment agent, or party to an external transaction.

If a user leaves We Eat through an external link and completes an order, reservation, payment, purchase, or other transaction on an independent website, application, or service, that transaction is between the user and the relevant third party and is subject to that third party’s terms and policies.

To the maximum extent permitted by applicable law, We Eat is not responsible for:

  • acceptance or rejection of an external order;
  • external payments;
  • food quality or safety;
  • delivery;
  • delays;
  • cancellations;
  • refunds;
  • reservations;
  • third-party customer service; or
  • performance of the external transaction.

Users are responsible for reviewing the identity, terms, privacy practices, payment conditions, and refund policies of the relevant third party before completing a transaction.

We Eat may remove or restrict links it reasonably considers unsafe, fraudulent, unlawful, or contrary to its policies.

If We Eat introduces its own ordering, payment, or reservation service in the future, that service may be subject to separate additional terms.

15. We Eat Intellectual Property

The We Eat name, trademarks, logos, designs, software, algorithms, interfaces, databases, technical architecture, graphics, and original platform features are owned by or licensed to We Eat and are protected by applicable intellectual property laws.

Unless expressly authorized by law or We Eat, users must not:

  • copy the platform or substantial parts of it;
  • redistribute its technology;
  • engage in unauthorized reverse engineering;
  • systematically extract platform data without authorization;
  • use unauthorized bots, crawlers, or scraping tools;
  • attempt to derive source code;
  • use We Eat trademarks without authorization; or
  • commercially exploit We Eat technology without permission.

16. Intellectual Property Complaints

Users must only publish material they own or are legally authorized to use.

Rights holders may submit intellectual property complaints through We Eat’s designated contact mechanisms.

We Eat may remove or restrict content subject to a valid legal infringement complaint.

Serious or repeat infringers may have their accounts restricted, suspended, or terminated where appropriate and lawful.

17. Privacy and Personal Information

Processing of personal information is governed by the We Eat Privacy Policy.

The Privacy Policy explains what information We Eat may collect and how it may be used, processed, stored, transferred, shared, and protected, as well as applicable user rights.

Where applicable law requires separate consent for a particular processing activity, such consent will be requested separately and will not be inferred solely from acceptance of these Terms.

18. Messaging and Social Interactions

Where We Eat provides messaging, comments, following, sharing, or other communication functionality, those features must be used lawfully and responsibly.

They must not be used for harassment, fraud, threats, phishing, spam, exploitation, or unlawful activity.

We Eat may process, review, or preserve information relating to such interactions where reasonably necessary for safety, investigation, fraud prevention, enforcement, or legal compliance, subject to applicable law and the Privacy Policy.

19. Advertising, Commercial Content and Sponsorships

We Eat may currently or in the future display or provide:

  • advertisements;
  • paid content;
  • promoted content;
  • sponsored content;
  • promoted accounts;
  • commercial partnerships;
  • commercial recommendations;
  • campaigns involving restaurants or brands; and
  • other commercial services.

Users, creators, restaurants, and businesses are responsible for disclosing sponsorships, payments, gifts, free meals, or other material commercial relationships where required by applicable law.

We Eat may label content as “Advertisement,” “Sponsored,” “Promoted,” or an equivalent designation.

We Eat may establish additional terms governing advertising and commercial services.

20. Free and Paid Plans

We Eat may provide a free plan and one or more paid plans.

Features, limits, and benefits available under each plan may vary from time to time.

Paid plans may include, for example, additional profile, content, description, field, badge, external-link, or other functionality offered by We Eat.

A paid subscription does not grant ownership of any platform feature or a permanent right to the indefinite continuation of a particular feature.

We Eat may develop or modify plans subject to applicable law, app-store requirements, and applicable consumer-protection requirements.

21. Paid Subscriptions and Automatic Renewal

We Eat may offer paid subscriptions, premium plans, and paid features.

Before confirming a subscription, users will be shown the applicable price, currency, billing period, principal benefits, and material financial terms required to be disclosed.

No current price constitutes a permanent or guaranteed price.

We Eat may, from time to time, increase, decrease, or otherwise modify subscription, plan, and paid-feature prices and may offer discounts, promotional pricing, or different prices where permitted by applicable law and the relevant app store.

The price, currency, billing period, and applicable taxes or charges displayed on the purchase screen before payment confirmation will constitute the applicable financial terms for that purchase.

Automatic Renewal

Where a subscription is offered on an auto-renewing basis, it will continue and renew according to the billing period disclosed at purchase until cancelled in accordance with the applicable payment provider and applicable law.

Apple App Store

Subscriptions purchased through the Apple App Store are processed, managed, renewed, cancelled, and refunded in accordance with applicable Apple systems and policies, in addition to mandatory rights provided by applicable law.

Google Play

Subscriptions purchased through Google Play are processed, managed, renewed, cancelled, and refunded in accordance with applicable Google Play systems and policies, in addition to mandatory rights provided by applicable law.

Cancellation

Users may cancel future subscription renewal using the mechanism provided by the applicable payment provider.

The subscription will generally remain active until the end of the current paid period unless applicable law or the payment provider requires otherwise.

Deleting the Application

Deleting the We Eat application from a device does not cancel a subscription.

Account Deletion

Deleting a We Eat account does not necessarily cancel an auto-renewing subscription administered by Apple, Google, or another independent payment provider.

Users are responsible for managing their subscriptions through the applicable payment provider, subject to any obligations imposed on We Eat by applicable law.

Refunds

Refund requests for purchases processed through Apple or Google may be subject to the applicable store’s refund procedures and policies.

Payments processed directly by We Eat are subject to the purchase terms presented at the time of purchase and applicable law.

Nothing in these Terms restricts mandatory statutory cancellation or refund rights.

Price Changes

We Eat may increase, decrease, or otherwise modify prices in the future.

For existing auto-renewing subscriptions, price changes will be implemented in accordance with applicable notice, consent, or other requirements imposed by law, the relevant app store, or payment provider.

We Eat does not guarantee that any price, discount, or promotional offer will remain available permanently.

Failed Payments

If payment cannot be successfully processed, access to paid features may be suspended or restricted until payment is successfully completed, subject to applicable law and payment-provider rules.

Subscription Expiration

When a subscription expires, the account may revert to a free plan and paid features may become unavailable.

Expiration of a subscription alone will not ordinarily result in deletion of the user’s account or content.

Trials and Promotions

We Eat may offer discounts, promotions, free trials, or introductory pricing.

Material terms of an offer will be disclosed before subscription where required by applicable law.

22. Boosts and Paid Promotional Features

We Eat may allow users to purchase Boosts or other promotional features intended to increase content visibility or promotion.

Boost pricing is not fixed or permanent.

We Eat may increase, decrease, or otherwise modify the price, operation, duration, scope, or available options of Boosts from time to time, subject to applicable law and payment-platform requirements.

The price, currency, and applicable details displayed before confirmation of a Boost purchase will apply to that purchase.

Purchasing a Boost does not guarantee any specific number of:

  • views;
  • likes;
  • followers;
  • comments;
  • orders;
  • customers;
  • sales;
  • conversions; or
  • other commercial or social outcomes,

unless We Eat expressly provides a specific guarantee otherwise.

Boost performance may vary based on audience availability, geography, content, eligibility, moderation, platform activity, technical conditions, and other factors.

Promoted content remains subject to these Terms and the Community Guidelines.

23. Future Services and Features

We Eat may develop or introduce additional services and features in the future, including commercial services, advertising services, subscriptions, and tools for creators, restaurants, or businesses.

Certain future features may be subject to additional terms presented when the relevant feature is used.

This Section does not represent that We Eat currently provides every such service.

24. User Responsibility and Assumption of Risk

Users are responsible for content they create, record, upload, publish, share, recommend, review, or promote.

Users are also responsible for their decisions, interactions, transactions, and conduct arising from their use of We Eat.

Users are responsible for independently verifying information before relying upon it, including:

  • food ingredients;
  • allergens;
  • cross-contamination risks;
  • preparation methods;
  • nutritional information;
  • food safety;
  • dietary suitability;
  • halal, kosher, vegan, vegetarian, or other dietary claims;
  • restaurant hygiene and safety;
  • restaurant or business identity;
  • menus;
  • prices;
  • operating hours;
  • locations;
  • promotions;
  • ratings;
  • recommendations; and
  • external links.

To the extent permitted by applicable law, users assume the reasonable risks associated with relying on User Content, restaurant information, recipes, recommendations, ratings, external links, or other third-party information.

25. No Third-Party Endorsement or Guarantee

Unless expressly stated by We Eat, the appearance, recommendation, ranking, promotion, verification, or continued availability of content, an account, restaurant, establishment, or link does not constitute endorsement, certification, or guarantee by We Eat.

We Eat does not guarantee the identity, conduct, reliability, accuracy, qualifications, legitimacy, or safety of any user, creator, restaurant, advertiser, business, or other independent third party.

The presence of a badge, verification indicator, or similar feature does not constitute a guarantee by We Eat of food quality, business quality, or every claim made by the relevant account unless We Eat expressly states otherwise.

Users are responsible for taking appropriate precautions when communicating with, dealing with, purchasing from, ordering from, visiting, or relying upon a person, restaurant, or business discovered through We Eat.

26. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless We Eat, the owning Company, its affiliates, officers, directors, employees, and representatives from third-party claims, liabilities, losses, and reasonable costs arising directly from:

  • the user’s unlawful use of the Services;
  • User Content published by the user;
  • a material breach of these Terms or the Community Guidelines;
  • infringement of third-party rights;
  • violation of applicable law by the user;
  • fraud; or
  • intentional misconduct.

This provision does not apply where prohibited by applicable law and does not require users to indemnify We Eat for We Eat’s own unlawful conduct.

27. Disclaimer of Warranties

To the maximum extent permitted by applicable law, We Eat and the Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We Eat does not warrant that:

  • the Services will always operate without interruption;
  • the Services will be completely free from errors or outages;
  • all information or content will be accurate or complete;
  • every violation will be detected immediately;
  • every restaurant, account, or third party will be reliable;
  • external links will always be safe or available;
  • recommendations will produce a particular result;
  • a subscription will produce a particular commercial or social result;
  • a Boost will produce a particular result; or
  • use of We Eat will produce any particular outcome.

Nothing in this Section excludes warranties or rights that cannot lawfully be excluded.

28. Limitation of We Eat’s Liability

To the maximum extent permitted by applicable law, We Eat, the owning Company, its affiliates, officers, directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Services where such liability may lawfully be excluded.

To the maximum extent permitted by applicable law, We Eat is not responsible for consequences arising from:

  • User Content;
  • user opinions;
  • reviews and ratings;
  • conduct of another user;
  • inaccurate information supplied by third parties;
  • acts or omissions of independent restaurants, cafés, or businesses;
  • recipes published by third parties;
  • ingredient or allergy information supplied by third parties;
  • quality or safety of food supplied by an independent third party;
  • decisions made by users in reliance on platform content;
  • transactions occurring outside We Eat;
  • orders, reservations, or payments made through external links;
  • independent third-party services; or
  • external content outside We Eat’s control.

Nothing in these Terms excludes liability that cannot lawfully be excluded, mandatory consumer rights, or other non-excludable liability.

29. Platform Safety and Security

Users must not:

  • attempt unauthorized access;
  • attack We Eat systems;
  • circumvent security measures;
  • distribute malicious software;
  • exploit vulnerabilities;
  • conduct unauthorized penetration testing;
  • disrupt the Services;
  • manipulate algorithms;
  • manipulate recommendation or ranking systems; or
  • attempt to damage We Eat’s technical infrastructure.

We Eat may investigate suspected activities, take appropriate action, and cooperate with competent authorities in accordance with applicable law.

30. Account Restriction, Suspension and Termination

We Eat may restrict, suspend, or terminate an account where reasonably necessary because of:

  • violation of these Terms;
  • violation of the Community Guidelines;
  • fraud;
  • unlawful activity;
  • security threats;
  • serious or repeated infringement of third-party rights;
  • circumvention of platform enforcement;
  • misuse of subscriptions, Boosts, or commercial features;
  • age or eligibility violations; or
  • legal or regulatory requirements.

Immediate action without prior notice may be taken in serious cases involving child safety, fraud, security, credible threats, or unlawful activity where permitted by law.

Notice, reasons, or appeal mechanisms will be provided where required by applicable law.

31. Account and Data Deletion

Users may request deletion of their We Eat accounts using the mechanism made available by We Eat.

Deletion of personal information and content associated with an account will be handled in accordance with applicable law and the Privacy Policy.

Certain information may be retained where reasonably necessary or legally required for legal compliance, security, fraud prevention, financial obligations, investigations, disputes, protection of legal rights, or technical backup processes.

Deleting a We Eat account does not automatically cancel a subscription administered by Apple, Google, or another independent payment provider.

32. Third-Party Services and Links

We Eat may integrate with app stores, maps, payment providers, social media services, websites, ordering or reservation systems, and other independent services.

Such services are governed by their own terms and privacy practices.

To the maximum extent permitted by applicable law, We Eat is not responsible for independent third-party services outside its control.

33. Service Availability and Changes

We Eat may develop, modify, add, remove, replace, restrict, suspend, or discontinue features or portions of the Services.

We Eat does not guarantee that any feature, plan, tool, design, algorithm, or service will remain available permanently.

Where a material change affects a paid service or mandatory contractual consumer right, it will be handled in accordance with applicable law and relevant payment-provider requirements.

34. Compliance With Laws and Regional Differences

Users must use We Eat in compliance with laws and regulations applicable to them.

Because We Eat operates globally, features, content, subscriptions, prices, payments, advertising, Boosts, links, or services may vary between countries or regions.

We Eat may implement geographical, age-based, legal, regulatory, or technical restrictions where reasonably necessary.

Availability of We Eat in a country or app store does not represent that every feature is legally available to every user in that jurisdiction.

35. Governing Law and Mandatory Local Rights

Subject to mandatory laws that cannot lawfully be waived, these Terms and the contractual relationship between We Eat and the user shall be governed by the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates.

Disputes shall be submitted to the competent courts of Dubai unless mandatory law applicable to the user provides a non-waivable right to another court, authority, or dispute-resolution mechanism.

Where a user is a consumer in a jurisdiction providing mandatory consumer-protection, jurisdictional, governing-law, or dispute-resolution rights that cannot lawfully be waived, nothing in these Terms is intended to deprive the user of those rights.

36. Apple App Store Users

If We Eat is downloaded through the Apple App Store, these Terms are between the user and We Eat and not between the user and Apple.

We Eat, rather than Apple, is responsible for the application and its content, subject to applicable law and applicable App Store requirements.

Use of the application is also subject to applicable Apple terms and rules.

Apple and its subsidiaries are third-party beneficiaries of provisions applicable to App Store distribution to the extent required under Apple’s applicable terms.

37. Google Play Users

If We Eat is downloaded through Google Play, use of the application is also subject to applicable Google Play terms and policies.

Where these Terms conflict with a mandatory Google Play requirement applicable to distribution of the application, that mandatory requirement will control to the extent necessary.

38. Changes to These Terms

We Eat may update these Terms from time to time to reflect changes in the Services, features, technology, business models, law, regulation, or security requirements.

The latest revision date will be displayed in this document.

Where applicable law requires advance notice or renewed acceptance for a material change, We Eat will provide such notice or request renewed acceptance as required.

Users who do not agree to revised Terms may stop using the Services and delete their accounts.

39. Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable in a particular jurisdiction, the remaining provisions will continue to apply to the fullest extent permitted by law.

Where reasonably possible, the affected provision will be interpreted or limited to the minimum extent necessary to make it lawful and enforceable.

40. No Waiver

Failure by We Eat to enforce a provision or right at a particular time does not constitute a waiver of that provision or right.

41. Assignment

Users may not assign or transfer their rights or obligations under these Terms without We Eat’s authorization where such restriction is permitted by law.

We Eat may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, financing, sale, or transfer of the business or platform, subject to applicable law.

42. Entire Agreement

These Terms, the Privacy Policy, the Community Guidelines, and any additional terms applicable to a specific service, feature, subscription, or purchase collectively form the legal framework governing use of We Eat.

Where specific additional terms apply to a particular service, those specific terms will control in relation to that service to the extent of any conflict.

43. Contact, Complaints and Legal Notices

For questions, complaints, intellectual property matters, privacy or safety concerns, or legal notices relating to We Eat:

Website: Www.getweeat.com

We Eat may provide additional contact or reporting mechanisms through the application or official website.

44. Final User Acceptance

By selecting “I Agree,” “Create Account,” “Sign Up,” or an equivalent confirmation, the user confirms that:

  • they have read and understood these Terms of Use;
  • they agree to be legally bound by them;
  • they satisfy applicable age and eligibility requirements;
  • they acknowledge the We Eat Privacy Policy; and
  • they agree to comply with the We Eat Community Guidelines.
